6-A Case

MEANING

The confiscation proceeding before the Collector when seized essential commodities — usually PDS rice — are to be forfeited; named for Section 6-A of the Essential Commodities Act.

The seizure report must reach the Collector "without unreasonable delay"; in practice the Additional/Joint Collector (Revenue) conducts the case, and the enquiry — statements, sampling, weighing whether the stock is really PDS-sourced — is classic Deputy Collector work. Section 6-B mandates show-cause notice and hearing before confiscation; 6-C gives an appeal to the notified judicial authority. Orders must be reasoned: courts have returned rice and cut confiscations where proof of PDS origin (fortified kernels, purchase-record mismatch, driver and miller statements) was thin.
